Terms and Conditions

  • Within these Terms and Conditions, a reference to the ‘Client’ shall be deemed to refer to the person with whom Smile Team has agreed to provide professional orthodontic services.
  • Eligibility to a refund under the On Time Guarantee shall arise following the expiration of ten (10) minutes following the client’s scheduled appointment time. If the client has not been admitted into Smile Team’s consulting rooms within ten (10) minutes of the scheduled appointment time, the client shall be entitled to receive a refund up to $100 calculated in 15 minute increments on the basis of $25.00 per increment. A client’s entitlement to a refund under the On Time Guarantee shall not exceed $100.
  • The On Time Guarantee shall not operate during Smile Team’s peak morning period of 8:00 am to 10 am and peak afternoon period 3:00 pm to 5:00 pm Monday to Sunday. A client shall not be eligible to receive a refund if the scheduled appointment time falls during these periods.
  • The On Time Guarantee shall not apply to any Late Scheduled Appointment that takes place within seven (7) days of the date that a client schedules such an appointment.
  • A refund payable to a client under the On Time Guarantee shall be paid by cheque made payable to the person listed on Smile Team’s internal database who is listed as having ‘Account Responsibility’.
  • Smile Team reserves the right to withhold any refund that may otherwise by payable under the On Time Guarantee if the client’s account with Smile Team is overdue or in arrears.
  • For the purposes of calculating waiting time, Smile Team will utilise its own internal timekeeping system. Although Smile Team will endeavour to synchronise its internal timekeeping system to Australian Eastern Standard Time (AEST) as accurately as possible, Smile Team shall not be held liable for any loss and damage arising from any inadvertent timing inaccuracies.
  • In the event of any dispute relating to the scheduled appointment time, the appointment time listed within Smile Team’s internal appointment system will be deemed to be the scheduled appointment time.
  • Smile Team reserves the right to vary or modify the Terms and Conditions of the On Time Guarantee at any time and without prior notice to its clients. In such a case the Terms and Conditions as modified will apply as from the date of modification.
  • Smile Team reserves the right to terminate the On Time Guarantee at any time and without prior notice to its clients.
